Spousal Support

jing (Edmonton)

My ex is a lawyer and insists that we use line 15000 on the tax returns to calculate support. I think this is unfair as she has a law firm business and can claim many expenses. This cause her income to be reduced a lot. I think she can manipulate her income and reduce it so I have to pay more in support. Is this unethical for a lawyer to do this? How do I find out if this is fair or not? I do not think so but she says this is the way it is done.

You're right, when people are self-employed or receive their income from a business they have an interest in we should look at more than their line 15000. There's some information about the calculation here: https://albertalegal.org/info/family-law/self-employment-income
